If during the first 30 days we don’t find a buyer for your home, we will not charge you the estate agency fee, and no setup fee or withdrawal fee.

How long is the Guarantee on for?
The Qualifying Period is 1st September 2021 up to and including 30th November 2021 for areas covered by our Birmingham, Bromsgrove, Halesowen, Redditch and Stourbridge branches.
When does the 30 days start?
New instructions: The first 30 days is defined as the 30 calendar days from when your property was first available for sale on Rightmove by AP Morgan at the agreed Qualifying Marketing Price within the Qualifying Period.
Existing clients: The first 30 days is defined as the 30 calendar days from when your property was first advertised for sale on Rightmove by AP Morgan at the agreed Qualifying Marketing Price within the Qualifying Period.
Fall through: The first 30 days is defined as the 30 calendar days from when your property was re-advertised for sale on Rightmove by AP Morgan at the agreed Qualifying Marketing Price, following the fall through within the Qualifying Period.
You must agree to advertise your property at the Qualifying Marketing Price agreed by AP Morgan and continue to advertise your property at that price for the entire 30-day period.
How long am I tied to AP Morgan?
You must instruct AP Morgan as a new client on a sole agency basis (for a minimum of our standard duration which is at least 12 weeks) within the Qualifying Period. Existing clients and any fall through properties would need to extend their agency period to 12 weeks in order to qualify for the Guarantee.
What does “find a buyer” mean?
Find a buyer is defined as a direct or indirect introduction (where the Buyer makes the purchase as a result of becoming aware that the Property was for sale through the marketing of your property by AP Morgan), of a buyer who goes on to exchange contracts for the sale of your property. An introduction includes, but is not limited to, providing details of the buyer to you, attempting to/or arranging a viewing for the buyer on or having communications with the buyer about your property.
What if I am an existing client from before the qualifying period?
AP Morgan may, at their sole discretion, within the Qualifying Period, offer this guarantee where you are an existing client of AP Morgan subject to a reduction in marketing price agreed by AP Morgan to the Qualifying Marketing Price. You would also need to extend the agency period to 12 weeks in order to qualify for the Guarantee.
Who doesn't qualify for the Guarantee?
If you are using our Online or Auction services or have Retirement, Shared Ownership or Multi listed properties you do not qualify for the sale Guarantee.
If you refuse an offer at or above the Qualifying Marketing Price then you are no longer able to qualify for the guarantee, for example If your agreed Qualifying Marketing Price is offers over £150,000 and refuse an offer of £150,001 you will automatically not qualify for the Guarantee even if you previously did qualify for the Guarantee.
What happens if my sale falls through?
Following a fall through of your sale AP Morgan will offer this guarantee providing the fall through is within the Guarantee Period and the other conditions listed herewith are upheld. You would also need to extend the agency period to 12 weeks in order to qualify for the Guarantee.
Dual Fee Liability
If you (the Seller) have previously instructed another agent to act for you, or if in the future you instruct another agent, you may become liable to pay the other agent a fee as well as any fee due to us under this Agreement. You should therefore consult the terms of business of any agreement you have entered into with the other estate agent.
